In the most recent news about Tom Delay, Texas state Democrats have wn an injunction to keep the state Republican Party from naming a replacement for Delay in the Texas election, arguing that Delay's move to Washington was a sham designed to allow the GOP to skirt election rules.

Frankly, I don't like what Delay did. In fact, I believe it IS a sham, basically. But, laws are laws, and Delay and his advisers apparently did what they had to to stay within the law and allow the GOP to nae a replacement. There are a handful of situations where a replacement can be made, and moving out of state is one of those.

In my heart, I would almost like to see the Democrats prevail on this one I think Delay is a snake and that what he did, while legal, was pretty slimy. But what I feel in my heart does not translate into Texas law. While this whole incident has certainly exposed a loophole in the law that we would do well to call into question, it is unfair, and, indeed, wholly unConstitutional, to hold Tom Delay and the Texas GOP responsible for a law that does not exist, and, further, has not even been proposed.

In the end, what will probably happen is the GOP will prevail in naming Delay's replacement. And the Democrats will certainly use the court battle pretty heavily in their campaign ads. And the outcome of the election is pretty much unforeseeable, as this race will be run without incumbents. And legislators will remember this election only as a blip on the radar and fail to enact any reform to safeguard against such future abuses.

Now, maybe what I need to do is see what I can do to get the GOP to name me to run in Delay's stead (LOL!)

Use of the law to your advantage is not a crime, and indeed is often encouraged (Tax laws).  The purpose of the law is to set the field.  As long as you play on the field, you are legal. 

Now, maybe what I need to do is see what I can do to get the GOP to name me to run in Delay's stead (!)
